Terms of Use

These Terms of Use ("Terms") govern your use of the Elation app and this website (the "Service"), provided by Seasoned Desenvolvimento de Software LTDA ("Seasoned", "we", "us"). By using Elation, you agree to these Terms. If you do not agree, please do not use the Service.

1. The service

Elation is a singing-practice app: you provide a reference recording, sing it a cappella, and the app scores your take against the reference on your device. The app stores your recordings and scores locally on your phone; optional features let you back up to your own cloud storage and send us feedback reports.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use Elation. If you are under 18, you confirm that a parent or guardian agrees to these Terms on your behalf. Purchases additionally require the legal capacity to contract and are subject to the rules of Apple's App Store or Google Play.

3. License

We grant you a personal, non-exclusive, non-transferable license to use Elation for your own, non-commercial singing practice. You agree not to resell the Service, abuse or disrupt its online components, or reverse engineer, decompile, or disassemble the app except where the law expressly permits it.

4. Your recordings and third-party content

Your recordings belong to you. They are created and stored on your device, and we claim no rights over them.

Elation does not include a music catalog and does not grant you any rights to songs or recordings. You are responsible for ensuring that the way you obtain and use reference material — including audio files and YouTube imports — complies with applicable law and the terms of the services it comes from. Elation is intended for private practice.

5. Feedback reports

If you choose to send a feedback report, you grant Seasoned a worldwide, royalty-free license to store and use the submitted material — your note, audio, and scoring data — for operating and improving the Service. Reports are anonymous; please do not include personal information about yourself or others, or content you have no right to share.

6. Elation Pro: subscriptions and Lifetime

• Elation Pro can be purchased as an auto-renewing monthly or yearly subscription, or as a one-time Lifetime purchase, billed through your App Store or Google Play account. Prices are shown in the app before purchase and may vary by country.
• Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period, in your store account settings. Deleting the app does not cancel the subscription.
• If a free trial is offered, the paid subscription starts when the trial ends unless you cancel before then. Any unused trial time is forfeited when you upgrade earlier.
• We may change subscription prices prospectively. The store will notify you and, where required, ask for your consent before a change applies to you.
• Refunds are handled by Apple and Google under their policies. Nothing in these Terms limits statutory rights you may have, including the 7-day withdrawal right under Article 49 of the Brazilian Consumer Defense Code where it applies.
• Elation Lifetime is a one-time purchase that unlocks Pro features permanently and does not renew. Like any store purchase, it is tied to your App Store or Google Play account and can be restored on your other devices signed in to that account.

7. Free tier

The free tier currently includes 3 practice clips with up to 3 takes each. We may adjust free-tier limits for the future; changes will not remove content already on your device.

8. Intellectual property

Seasoned retains all rights, title, and interest in Elation, including its software, design, brand, and scoring technology. Open-source components included in the app remain subject to their own licenses.

9. Practice tool, not professional advice

Elation is a practice companion. It does not replace professional voice instruction, and its scores and cues are automated estimates that can be wrong — they are feedback, not a verdict on your ability.

Singing involves physical effort. If you feel pain, hoarseness, or strain, stop and rest; persistent symptoms belong with a doctor or qualified voice professional, not an app.

10. Warranty and liability

We are responsible for the legal warranty of conformity provided by the Brazilian Consumer Defense Code (CDC) and offer no additional contractual warranties. If the Service presents a defect, we will have 30 days to correct it, after which you may request the remedies provided by the CDC.

To the extent permitted by applicable law, Seasoned is liable only for direct damages proven to result from a defect in the Service, and not for indirect or speculative damages such as lost profits or lost opportunities — including the outcome of any audition, performance, or examination. Nothing in these Terms excludes liability that cannot be excluded under applicable consumer law.

11. Termination

You may stop using Elation at any time; uninstalling the app deletes the data stored on your device. We may suspend or terminate access to the Service's online components for violations of these Terms or other legitimate reasons, with reasonable notice except for severe violations.

12. Governing law

These Terms are governed by the laws of Brazil. Disputes will be resolved in the courts of Porto Alegre, RS, Brazil, without prejudice to mandatory consumer protections and venues that apply where you live.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on this page with the date above updated; your continued use of the Service after a change constitutes acceptance.

14. Language

These Terms may be presented in several languages for convenience. In case of conflict between versions, the English version prevails.
